Welcome to NUVIRTUS. These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and platform. By using NUVIRTUS, you agree to be bound by these Terms. If you do not agree, you may not access or use our services.
1. Our Role
NUVIRTUS is a premium platform that connects hosts who offer luxury properties with guests seeking high-end accommodations worldwide. We are not a property manager, real estate broker, or insurer. We facilitate bookings and provide a secure environment for transactions, but we do not own, control, or manage any of the listings on our platform.
Each booking is a contractual agreement directly between the guest and the host. NUVIRTUS is not a party to that contract and does not assume any legal responsibility for the acts or omissions of either party.
2. Account Registration
To book or list a property on NUVIRTUS, you must create an account and provide accurate, complete, and up-to-date information. You are responsible for safeguarding your account credentials and for any activity conducted under your account.
You agree not to use false information or impersonate another person or entity. NUVIRTUS reserves the right to suspend or terminate accounts found to be in violation of these requirements.
3. Booking and Payments
When a guest requests a booking and the host accepts, a reservation is confirmed. At that point, both parties are bound by the terms of the reservation, including cancellation policies, house rules, check-in/check-out times, and all applicable fees.
By confirming a booking, guests also agree to be bound by our Rental Agreement Terms & Conditions, which govern the specific rental relationship between guest and host and are incorporated herein by reference.
Payments are processed securely through our platform. Guests will be charged the full amount at the time of booking, unless otherwise stated. This includes nightly rates, cleaning fees, service charges, security deposits, and local taxes where applicable.
All payment transactions must be completed on our platform. Off-platform or cash transactions are strictly prohibited and may result in removal from NUVIRTUS.
4. Cancellation Policies
NUVIRTUS allows hosts to select one of several cancellation policies:
- Flexible: Full refund up to 24 hours before check-in
- Moderate: Full refund up to 5 days before check-in
- Firm: 50% refund up to 7 days before check-in
- Strict: No refund within 14 days of check-in
Cancellation terms are clearly displayed on each listing. Guests are responsible for reviewing the policy prior to booking.
In exceptional cases such as natural disasters, severe illness, or government travel bans, we may override the standard policy under our Force Majeure clause and provide alternative options or refunds.
5. Guest Responsibilities
Guests are expected to behave respectfully and in accordance with the rules of the host and the property. This includes:
- Adhering to maximum occupancy limits
- Avoiding excessive noise or disruptive behavior
- Following check-in and check-out times
- Leaving the property in good condition
Guests may be charged for any damage caused or for excessive cleaning if the property is left in poor condition. Repeated violations may lead to account suspension or permanent removal from NUVIRTUS.
6. Host Responsibilities
Hosts must:
- Provide accurate property descriptions and photos
- Maintain the property in a clean and safe condition
- Ensure the property is available and ready at check-in
- Honor all accepted reservations unless due to unforeseen emergencies
Hosts are responsible for resolving any issues that arise during a guest’s stay and for complying with local laws and regulations, including tax obligations.
7. Security Deposits and Damages
Some listings require a security deposit, which is clearly stated at the time of booking. If damage is reported, NUVIRTUS will notify the guest and facilitate communication between both parties. In cases where no resolution is reached, NUVIRTUS reserves the right to mediate and, if necessary, charge the guest up to the deposit amount or more if warranted.
8. Modifications and Cancellations by Hosts
If a host cancels a confirmed reservation, NUVIRTUS will assist the guest in finding a comparable alternative. If none is available, a full refund will be issued. Frequent cancellations by hosts may result in penalties or removal from the platform.
9. Platform Integrity and Fair Use
You agree to use NUVIRTUS only for lawful purposes and in accordance with these Terms. Prohibited activities include, but are not limited to:
- Misusing or tampering with the platform
- Posting false or misleading content
- Harassing or abusing other users
- Circumventing fees or promoting off-platform bookings
NUVIRTUS reserves the right to monitor usage, investigate complaints, and take any necessary actions to preserve platform integrity.
10. Liability Limitations
NUVIRTUS is not liable for:
- The accuracy of listings or quality of accommodations
- Acts or omissions of hosts or guests
- Personal injury, loss, or damage during a stay
- Delays, cancellations, or service interruptions due to force majeure
Our maximum liability under any circumstance is limited to the amount paid for the booking in question.
11. Privacy
We respect your privacy. Your personal data is processed in accordance with our Privacy Policy, which outlines how information is collected, used, and protected.
12. Dispute Resolution
We encourage users to resolve disputes directly whenever possible. If no agreement can be reached, NUVIRTUS may intervene as a neutral party. For unresolved legal claims, parties agree to resolve disputes through binding arbitration or in the courts of the State of Wyoming, USA.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Wyoming, United States. Any disputes arising from these Terms or use of the NUVIRTUS platform shall be resolved under the exclusive jurisdiction of the courts located in Sheridan County, Wyoming.
