This Rental Agreement (“Agreement”) is a legally binding contract between the property owner or authorized manager (“Host”) and the individual making the reservation (“Guest”). By completing a booking through the Nuvirtus platform, the Guest agrees to all terms set forth in this Agreement, in the Nuvirtus Terms and Conditions, and in the property-specific house rules provided at the time of booking.
This Agreement is governed by the laws of the State of Delaware, USA, consistent with the governing law applicable to the Nuvirtus platform.
1. Parties to the Agreement
Host: The property owner or authorized property manager who has listed the accommodation on the Nuvirtus platform. The Host’s identity, contact information, and property details are set out in the booking confirmation sent to the Guest upon reservation.
Guest: The individual who has completed the booking process on the Nuvirtus platform and who accepts personal responsibility for compliance with this Agreement on behalf of themselves and all members of their travel party.
Platform: Nuvirtus LLC, which acts as a booking facilitator and is not a party to the rental contract between Host and Guest, except as expressly stated herein.
2. The Property
The accommodation subject to this Agreement is the property listed on the Nuvirtus platform at the time of booking (the “Property”). The Property is made available exclusively for temporary vacation or short-term residential use by the Guest and their permitted travel party. Any other use is strictly prohibited without the prior written consent of the Host.
The Guest acknowledges having reviewed the property listing, photographs, description, amenities list, and house rules prior to booking and accepts the Property in its described condition.
3. Reservation Period
The rental period commences at the check-in time specified in the booking confirmation (standard check-in: 15:00 local time) on the arrival date and concludes at the check-out time specified in the booking confirmation (standard check-out: 11:00 local time) on the departure date (collectively, the “Rental Period”).
The Guest may not occupy the Property before the agreed check-in time or after the agreed check-out time without the explicit prior written consent of the Host. Unauthorized early check-in or late check-out may result in additional charges at the Host’s discretion.
The Rental Period is fixed and does not automatically renew. Any extension of the stay beyond the confirmed departure date must be agreed in writing by the Host and is subject to availability and additional payment.
4. Payment Terms
All payments for the reservation, including nightly rates, applicable taxes, cleaning fees, and any security deposit, are processed securely through the Nuvirtus platform at the time of booking or as otherwise specified during the checkout process.
By completing a booking, the Guest authorizes Nuvirtus to charge the total amount shown at checkout to the payment method provided. All amounts are quoted and charged in the currency displayed at checkout. Currency conversion fees, if any, are the responsibility of the Guest’s bank or payment provider.
Nuvirtus processes payments on behalf of the Host. Funds are held by Nuvirtus and transferred to the Host according to the payout schedule set forth in the Host’s separate agreement with Nuvirtus.
Off-platform payments — meaning any direct financial transaction between Guest and Host that circumvents the Nuvirtus payment system — are strictly prohibited and may result in the cancellation of the reservation and suspension of both parties’ accounts.
5. Cancellation and Refund Policy
Each property listed on Nuvirtus is subject to one of the following cancellation policies, clearly indicated on the listing page at the time of booking. By completing the reservation, the Guest accepts the cancellation policy applicable to the specific property booked.
5.1 Flexible Policy
The Guest is entitled to a full refund of the total amount paid (including cleaning fee) if the reservation is cancelled at least 24 hours before the scheduled check-in time. Cancellations made within 24 hours of check-in are non-refundable. The first night and the cleaning fee are non-refundable if the Guest cancels after check-in.
5.2 Moderate Policy
The Guest is entitled to a full refund of the total amount paid (including cleaning fee) if the reservation is cancelled at least 5 full days before the scheduled check-in date. Cancellations made within 5 days of check-in are non-refundable. The first night and the cleaning fee are non-refundable if the Guest cancels after check-in.
5.3 Firm Policy
The Guest is entitled to a full refund if the reservation is cancelled at least 7 full days before the scheduled check-in date. Cancellations made between 7 and 1 day(s) before check-in are entitled to a 50% refund of the nightly rate for all unspent nights; the cleaning fee is non-refundable. Cancellations made within 24 hours of check-in are non-refundable. The first night and the cleaning fee are non-refundable if the Guest cancels after check-in.
5.4 Strict Policy
The Guest is entitled to a full refund if the reservation is cancelled at least 14 full days before the scheduled check-in date. Cancellations made between 14 and 7 days before check-in are entitled to a 50% refund of the nightly rate; the cleaning fee is non-refundable. Cancellations made within 7 days of check-in are non-refundable in their entirety.
5.5 Non-Arrival
If the Guest fails to arrive on the scheduled check-in date without providing prior notice of cancellation, the reservation is treated as a no-show. No refund will be issued for a no-show, regardless of the applicable cancellation policy.
5.6 Host Cancellations
In the event that the Host cancels a confirmed reservation, the Guest will receive a full refund of all amounts paid within 5–10 business days to the original payment method. Nuvirtus may also, at its discretion, offer the Guest alternative accommodation or a platform credit. Hosts who cancel confirmed reservations are subject to penalties as set forth in the Host’s agreement with Nuvirtus, which may include review penalties, calendar blocking, and account suspension.
5.7 Force Majeure
In the event of cancellation due to extraordinary circumstances beyond either party’s reasonable control — including but not limited to natural disasters, governmental travel restrictions, acts of war or terrorism, or declared public health emergencies — Nuvirtus may, at its sole discretion and on a case-by-case basis, facilitate a full or partial refund, a reservation credit, or a date change. The applicability of this provision is determined by Nuvirtus based on the nature of the event and applicable law. Guests seeking relief under this provision must submit a request to Nuvirtus support with supporting documentation within 72 hours of the qualifying event.
5.8 Refund Processing
Approved refunds are processed to the original payment method within 5–10 business days of the cancellation confirmation. Processing times may vary depending on the Guest’s bank or payment provider. Nuvirtus is not responsible for delays caused by third-party financial institutions. Platform service fees paid by the Guest at the time of booking are refunded in full in cases of Host-initiated cancellation and in accordance with the applicable Guest cancellation policy for Guest-initiated cancellations.
6. Security Deposit
Certain properties require a security deposit as a condition of booking. Where applicable, the security deposit amount is clearly displayed on the listing page and in the booking confirmation.
6.1 Collection
The security deposit is collected separately from the reservation payment, either at the time of booking or at check-in, as specified by the Host. Payment of the security deposit does not reduce the Guest’s liability for damages; it represents a pre-authorized amount held against potential claims.
6.2 Return
The security deposit will be returned in full — or released if pre-authorized — within 5 business days of the Guest’s check-out, provided that:
- No damage claim has been filed by the Host within 48 hours of check-out;
- The Property has been left in the condition described in this Agreement and the house rules;
- No additional charges are outstanding (e.g., extra guest fees, penalty charges for rule violations).
6.3 Damage Claims
If the Host files a damage claim within 48 hours of check-out, Nuvirtus will initiate a mediation process. Both parties will be given the opportunity to present evidence (photographs, inventory records, third-party assessments). Nuvirtus will issue a determination within 10 business days of receiving all required documentation. Charges substantiated by the evidence may be deducted from the security deposit. Any remaining balance is returned to the Guest within 5 business days of the determination. Damage claims exceeding the security deposit amount may be pursued by the Host through separate legal channels.
7. Guest Occupancy and Conduct
7.1 Authorized Occupancy
The Property may only be occupied by the number of guests specified in the booking confirmation. Any additional guests must be pre-approved in writing by the Host and may be subject to additional fees. Unauthorized excess occupancy constitutes a material breach of this Agreement and may result in immediate termination of the stay without refund.
7.2 House Rules
The Guest agrees to comply with all house rules provided by the Host at the time of booking and made available in the property. House rules may include, without limitation, provisions regarding noise levels, quiet hours, smoking and vaping policies, pet permissions, parking, use of common areas, waste disposal, and recycling requirements.
7.3 Prohibited Activities
The following activities are strictly prohibited at the Property:
- Hosting parties, events, or gatherings beyond the maximum authorized occupancy;
- Subletting, re-letting, or otherwise granting third-party access to the Property;
- Commercial, business, or unlawful activities of any kind;
- Smoking or vaping inside the Property unless explicitly permitted by the Host;
- Bringing pets onto the Property unless explicitly authorized by the Host;
- Creating excessive noise that disturbs neighboring residents, particularly during quiet hours;
- Tampering with, disabling, or covering any smoke detectors, carbon monoxide detectors, or other safety equipment;
- Making any alterations to the Property or its contents without the Host’s written consent.
Violation of any of the above may result in immediate termination of the rental, eviction from the Property, forfeiture of the security deposit, and the Guest’s full financial liability for any resulting damages, fines, or legal costs.
7.4 Check-In and Check-Out
The Guest is responsible for following the check-in and check-out procedures provided by the Host. The Guest must ensure that the Property is left in a clean and orderly condition at departure: all dishes washed or in the dishwasher, garbage disposed of as instructed, personal belongings removed, windows closed, and all access codes/keys/fobs returned or secured as directed. Failure to comply may result in additional cleaning charges deducted from the security deposit.
8. Host Access Rights
The Host or their authorized representatives reserve the right to access the Property at any reasonable time during the Rental Period for purposes of emergency maintenance, safety inspections, or urgent repairs. In non-emergency situations, the Host will provide the Guest with at least 24 hours’ prior notice before accessing the Property. The Guest’s right to quiet enjoyment of the Property is respected throughout the Rental Period, balanced against the Host’s legitimate need for access.
9. Guest Responsibilities and Liability
The Guest accepts the Property in the condition described in the listing and agrees to maintain it in a comparable condition throughout the Rental Period. The Guest is solely and directly liable for:
- Any damage to the Property, its contents, or common areas caused by the Guest or their travel party, whether intentional or through negligence;
- Any fines, penalties, or legal costs incurred by the Host as a direct result of the Guest’s violation of local ordinances, noise regulations, or applicable law during the Rental Period;
- The cost of any extraordinary cleaning required beyond the standard cleaning covered by the cleaning fee;
- Replacement costs for any items belonging to the Property that are lost, stolen, or broken during the Guest’s stay.
The Guest’s liability is not limited to the amount of the security deposit. Where damage or costs exceed the deposit, Nuvirtus may facilitate recovery of the difference through the Guest’s payment method on file, subject to the dispute process described in Section 6.3.
10. Host Responsibilities
The Host warrants that:
- The Property is accurately described in the listing, including photographs, amenities, location, and applicable house rules;
- The Property is in a clean, safe, and habitable condition at the time of the Guest’s check-in;
- All appliances, fixtures, and amenities described in the listing are functional and available for the Guest’s use;
- The Property complies with all applicable local health, safety, and building regulations;
- The Host holds all required permits, licenses, or authorizations for vacation rental activity in the property’s jurisdiction (Nuvirtus bears no responsibility for the Host’s regulatory compliance).
In the event that the Property is materially different from its description upon the Guest’s arrival (e.g., significant amenities missing, safety hazards present), the Guest must notify the Host and Nuvirtus within 24 hours of check-in. Nuvirtus will investigate and may, at its discretion, offer the Guest a partial or full refund, alternative accommodation, or a platform credit.
11. Limitation of Liability
Nuvirtus acts solely as a booking facilitator and is not a party to the rental contract between Host and Guest. To the maximum extent permitted by applicable law, Nuvirtus’s total liability to any user arising from or in connection with any booking shall not exceed the total amount paid by that user for the booking in question.
Neither the Host nor Nuvirtus is liable for: (a) loss or theft of the Guest’s personal belongings at or near the Property; (b) personal injury or property damage not caused by the Host’s gross negligence or willful misconduct; (c) disruptions caused by circumstances beyond the Host’s control (construction, utility outages, weather events); or (d) any consequential, indirect, or punitive damages arising from the rental.
The Guest is strongly encouraged to obtain travel insurance covering trip cancellation, personal liability, and theft of personal belongings.
12. Privacy and Data
Personal data collected in connection with this Agreement is processed in accordance with Nuvirtus’s Privacy Policy. By completing a booking, the Guest consents to the sharing of their name, contact details, and booking information with the Host for the purposes of facilitating the stay.
13. Dispute Resolution
In the event of a dispute between the Guest and the Host arising from this Agreement, both parties agree to first attempt resolution through Nuvirtus’s dispute mediation service by contacting support@nuvirtus.com. Nuvirtus will review the available evidence and issue a non-binding recommendation within 10 business days.
If the dispute cannot be resolved through mediation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, as further described in the Nuvirtus Terms and Conditions. This Agreement is governed by the laws of the State of Delaware, USA.
14. Entire Agreement
This Agreement, together with the Nuvirtus Terms and Conditions, the Privacy Policy, the booking confirmation, and the property-specific house rules, constitutes the entire agreement between the Host and the Guest with respect to the rental of the Property and supersedes all prior communications, representations, or agreements, whether oral or written, relating to the same subject matter.
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15. Acceptance
By completing a reservation on the Nuvirtus platform, the Guest confirms that they have read, understood, and agree to be bound by this Rental Agreement in its entirety. No physical signature is required; completion of the booking process constitutes acceptance of these terms.
