By confirming a booking on NUVIRTUS, you acknowledge and agree to be bound by these Rental Agreement Terms, which form the legal contract between you (the Guest) and the property owner (the Host).
These Rental Terms are supplementary to and must be read in conjunction with the NUVIRTUS Terms & Conditions, which continue to apply throughout your use of the platform. In case of conflict between these documents, the more specific rental terms shall prevail for rental-related matters.
PARTIES TO THE AGREEMENT
LANDLORD (HOST): The property owner as identified in the booking confirmation
TENANT (GUEST): The person making the reservation and all authorized occupants
Both parties acknowledge having the necessary legal capacity to enter into this rental agreement.
ARTICLE 1: OBJECT OF RENTAL
The Host rents to the Guest the property identified in the booking confirmation for temporary accommodation during the period specified in the reservation. This rental is intended for short-term lodging purposes only and does not constitute the Guest’s permanent housing solution.
The property is rented for use other than primary residence.
ARTICLE 2: HOST ACCESS RIGHTS
The Guest expressly acknowledges and consents that the Host retains the right to access the rented property for legitimate purposes including:
- Maintenance services
- Cleaning services
- Emergency repairs
- Safety inspections
- Property management activities
Access will be provided with reasonable notice except in emergency situations.
ARTICLE 3: RENTAL PERIOD
This agreement is valid for the specific dates confirmed in your NUVIRTUS booking. Upon expiration of the rental period, the agreement terminates automatically without prior notice. The Guest must vacate the property and return all keys and access devices by the specified check-out time.
ARTICLE 4: PAYMENT TERMS
The Guest acknowledges that payment for the agreed rental amount has been processed through the NUVIRTUS platform. Payment includes all fees specified in the booking confirmation and covers the full rental period as agreed.
ARTICLE 5: OBLIGATIONS AND RESPONSIBILITIES
5.1 Host Obligations
The Host is obliged to maintain the property in proper condition throughout the rental period as mutually agreed and described in the listing.
5.2 Guest Conduct
The Guest undertakes not to use the property in any manner that is:
- Annoying, unhealthy, noxious, or dangerous to neighbors or the community
- Disruptive to the peaceful enjoyment of surrounding properties
- In violation of local laws, regulations, or community standards
5.3 Property Rules Compliance
The Guest expressly agrees to comply with all property rules as specified in the listing description and house rules, including but not limited to respecting neighbors’ peace and quiet.
5.4 Guest Liability
The Guest is directly and exclusively responsible for:
- Any damage caused to persons or property arising from use of the property’s facilities or services
- Any damage or loss occurring on the property, whether caused by the Guest or authorized occupants
- All costs associated with repairs or replacement of damaged items
The Host and NUVIRTUS disclaim liability for incidents occurring during the Guest’s stay, except where prohibited by applicable law.
5.5 Modifications Prohibited
Any construction work, alterations, or modifications to the property are strictly prohibited without prior written permission from the Host.
5.6 Subletting and Transfer Restrictions
The Guest undertakes not to sublet, assign, or transfer the rental agreement in whole or in part without express written consent from the Host. Violation of this clause will result in immediate termination of the agreement.
The Guest waives rights of preferential acquisition, subrogation, assignment, transfer, retraction, and rights to challenge any transmission of the property.
ARTICLE 6: STANDARD PROPERTY RULES
Check-in/Check-out Times
- Check-in: 15:00h (3:00 PM)
- Check-out: 11:00h (11:00 AM)
- Alternative arrangements require prior host approval
Occupancy Limits
- Maximum capacity as specified in the listing must not be exceeded
- Unauthorized guests may result in immediate termination without refund
- External visits require prior notification to the Host
Prohibited Activities
- Parties or events are strictly forbidden and will result in immediate expulsion without refund
- Excessive noise is prohibited, especially after 22:00h (10:00 PM)
- Smoking restrictions as specified in property rules must be observed
Cleanliness and Care
- Guests must maintain the property in clean condition
- Towels and linens provided are for accommodation use only
- Additional cleaning fees may apply for excessive mess
- Dishes and kitchen items must be cleaned and properly stored
Utility Usage
- Fair energy consumption is expected
- Utilities are included up to reasonable daily limits
- Excessive consumption may result in additional charges
- Energy-saving practices are encouraged and appreciated
Damage and Additional Charges
- Guests accept full financial responsibility for any damage beyond normal wear and tear
- Additional charges may be applied for:
- Property damage
- Excessive cleaning requirements
- Utility overconsumption
- Rule violations
- NUVIRTUS reserves the right to charge the provided payment method for additional costs
ARTICLE 7: GOVERNING LAW AND JURISDICTION
This rental agreement is subject to the jurisdiction of the courts where the property is located. The parties expressly submit to this jurisdiction and renounce any other that might correspond to them.
The laws of the country/region where the property is situated shall apply to this contract, with the local language version taking precedence in case of disputes.
ARTICLE 8: AGREEMENT ACKNOWLEDGMENT
By completing your booking on NUVIRTUS, you acknowledge that you have:
- Read and understood all terms of this rental agreement
- Reviewed and accepted all property-specific rules
- Agreed to comply with all obligations outlined herein
- Accepted full responsibility for your conduct and that of all occupants
Failure to comply with these terms may result in immediate termination of the rental agreement without refund and potential legal action for damages.
This agreement is entered into electronically through the NUVIRTUS platform upon booking confirmation.
